ACCEPTANCE OF TERMS THROUGH USE
By using this service, you signify your agreement to all terms, conditions, and notices contained or referenced herein (the "Terms of Use"). INDEMNIFICATION
Upon a request by Znet you agree to defend, indemnify, and hold harmless Znet and its subsidiary and other affiliated companies, and their employees, contractors, officers, and directors from all liabilities, claims, and expenses, including attorney's fees, that arise from your use or misuse of this site or service. Znet reserves the right, at it own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Znet in asserting any available defenses.
INTERNATIONAL USE
Znet makes no representation that materials on this site are appropriate or available for use in locations outside the United States, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws.
CHOICE OF LAW AND FORUM
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Minnesota, excluding its conflicts of law rules. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms of Use or your use of this site shall be filed only in the state or federal courts located in the State of Minnesota, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.
SEVERABILITY AND INTEGRATION
Unless otherwise specified herein, this agreement constitutes the entire agreement between you and Znet with respect to this site and supersedes all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and Znet with respect to this site. If any part of these Terms of Use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
ZNET WEB MAIL REGISTRATION AGREEMENT
If you use Znet Web Mail, your use of Znet Web Mail software (the "Software") constitutes your acceptance and agreement of the following: You understand and reaffirm your agreement to Znet's then-current Terms of Service. You further agree and acknowledge that by using the Software to access the Znet service, you will be subject to any applicable charges for the use of the Znet service as set forth in the terms and conditions of the pricing plan you have chosen.
You understand that Znet provides no assistance, including any technical or customer support, in the use of the Software, and that your use of the Software is at your own risk. The Software is provided "AS IS" and "AS AVAILABLE" and no warranties are provided, except as required by law. SPECIFICALLY, THE WARRANTIES FOR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY DISCLAIMED.
Znet is in no way liable for any claims arising from your use of the Software. As a condition of your use, you agree to indemnify Znet for all claims relating to your downloading, use, reproduction of, and/or receipt or distribution of content through, the Software. Znet reserves the right, in its sole discretion and at any time, to modify or discontinue the Software; limit, terminate or suspend your use of the Software; assess charges for the use of the Software in the future; and/or make changes to this Registration Agreement.
ZNET WEB MAIL BILLING NOTICE
Znet members who are on an hourly pricing plan will be subject to normal hourly charges for this session in accordance with Znet's standard billing practices. For more details, please contact our billing office at billing@2z.net.
TERMINATION
Znet reserves the right, in its sole discretion, to terminate your access to all or part of this service, with or without notice.
BILLING PROCEDURES
Invoices are sent within the first week of the month to an email address that you specify. You are responsible for contacting Znet if you have changed or discontinued using your email address. If you prefer a paper invoice, a $0.50 postage and handling will be added each billing cycle. Invoices are due 15 days after the date of the invoice. If the account is not paid after 45 days, a $10 late fee will be added to the account. If the account is not paid after 60 days, the account will be placed on hold for non-payment and a additional $75 collection fee will be added to the account. If the account is not paid in full within 75 days, the account will then be sent to Conciliation Court and a $30 court fee will be added on.
To cancel your account, you must call or write to the Znet billing . If there are more than 2 weeks left of your service, we will issue a refund check within 90 days. We will not refund an account under 14 days. If you are in a pre-paid plan and cancel, you will be charged to the nearest plan, plus each additional month until the cancellation date.
If your account is going to be inactive for more than 1 month, or if you are having computer problems and wish to suspend your account, you can place your account on Vacation Mode there is no charge. The minimum Vacation Mode is 1 month. Please contact Znet and your account will be suspended as of the day you called. We can not backdate your account.
Znet reserves the right to require a credit card or automatic deduction from a checking or savings account, for accounts that are more than 45 days past due, or accounts that are continually past due.
Znet will add $20 on all returned checks. If the account is on hold, the full amount including all fees, must be paid before the account can be reinstated.
